A digital disconnection protocol is a document that establishes the internal provisions and measures adopted by a company to guarantee employees' right to disconnect from work-related digital communications outside of their working hours.

This protocol applies to both on-site and remote employees, regardless of whether they work full-time or part-time.

Legal Framework

Article 18 of the Remote Work Law establishes that employees working remotely have the right to digital disconnection outside of their working hours, in accordance with Article 88 of Organic Law 3/2018, of December 5.

Right to Digital Disconnection in the New Draft Law

The new draft law reinforces the non-waivable nature of digital disconnection, ensuring that employees cannot be required to perform work outside of their agreed schedule. This right aims to protect:

Rest periods

The appropriate use of digital tools such as video surveillance and geolocation systems
